POLYBUTYLENE PIPE
Because of the confusion and lack of understanding of the issue of
POLYBUTYLENE pipe, We offer the following information from Trish and
Chuck Dawson.
Summarizing the complaint of the Cox Class Action Suit, which brought
the matter to the public. below are the important points:
* The Cox Class Action Suit covers plaintiffs bound by and entitled
to share in the settlement approved in the case; specifically, present,
past and future owners of US residences and mobile homes, if PB in-house
plumbing with either plastic or metal fittings or PB yard service lines
were installed therein between January 1,1978 to July 3l, 1995.
A settlement was agreed to which covers reimbursement for leak expenses
incurred prior to August 21,1995 and beyond.
* In order to recover, there must be a "Qualifying Leak", and unwanted
water discharge occurring in certain specified time periods due to a
failure in the PB in-house plumbing or yard service line, subject to
certain exclusions.
* It should be emphasized that the court's approval of the settlement
is not a ruling that PB pipe is defective, nor does the Cox settlement
change what is permitted by applicable building codes;
1)13 pipe with metal (copper and brass) insert fittings continues to
meet builder's code ii) Albuquerque, according to the Mechanical
Supervisor of the City's Building & safety Division.
For more information, refer to Consumer Plumbing Recovery Center
